ALL ITEMS ARE SOLD “AS IS” – NO WARRANTIES

 

The BLOCK ONLINE AUCTION (“THE BLOCK”) is an online auction of primarily new and like new items.  The highest bid at the time of auction close will be the winning bid for the item.  By placing a bid, you acknowledge and agree to be bound by all the terms and conditions set forth herein.  

 

Bidder’s Account

Before a bidder’s first bid, they must register for an account and provide a valid credit card. To remain in good standing, bidders must comply with all Terms and Conditions. By registering and placing a bid, the bidder agrees to be bound by these Terms and Conditions.

 

Reserves, Increments, Auction Extension:

There are no reserves.  The minimum bid is $1.00, and the minimum bidding increment is $1.00.  During the last minute of bidding, a new bid will extend the time for the auction by 1 minute until such time as no additional bids are received during the final minute (or extended minutes) of the auction. Bids, once made, cannot be retracted or deleted.  If you are unsure about any of the Terms and Conditions, pricing, or condition notations, as described below, THE BLOCK suggests that you do not bid as all sales are final and no refunds will be given.

 

Item Condition, Description, Warranty:

The description of an item and its condition is provided to the best of THE BLOCK’s knowledge.

 

Manyofthe items offered are either new or returns. Some of the items may have been previously opened, used, or even damaged. The stock images, titles, and retail prices come directly from the liquidator of the goods and are representative of the original product. Bidders should note the item’s description and review the images that are listed with each item. None of our items are guaranteed or warranted. It is the bidder’s responsibility to make themselves aware of all of the provided descriptions and photos. ALL SALES ARE FINAL. Items are sold as is with no warranty. No refunds will be made.

 

THE BLOCK identifies a specific item condition for each item according to the following CONDITION NOTATIONS.

 

CONDITION NOTATIONS

 

New: Items in new condition and not previously used.   If the box is open but the item does not appear to have been ever removed from the box, “open box” will be noted.

 

Like New, Open Box: Items appear to be in new condition.  Original packaging may be missing or damaged, with minimal to no damage to the item.

 

Good, Open Box: Items may have visible issues of varying degrees.  Item is not used but may be incomplete due to packaging damage or other issues.  Item may have some damage that does not affect its functionality but is not tested for functionality. 

 

Used: Items have been used but appear to be in usable condition.  There is no guarantee that the product is functional or usable.  Signs of use may include, but are not limited to scratches, dents, breaks and wear.  These items may be incomplete to varying degrees and could have more damage than found while being inventoried for sale.

 

Salvage: Items have an unknown condition.  While some are in original packaging, they may be damaged or non-functional. Major components may be missing and sets may be incomplete.  Please carefully review photos provided.

 

Other – Occasionally, when items appear new, like new, or good, but may be missing something, they will be listed as New—Other, Like New—Other, or Good—Other, and a description of the missing parts will be noted to the best of THE BLOCK’s ability.  

 

Please read our notations carefully before bidding.  Your bid is a consent to the item condition. All sales are final and no refunds will be made. 

 

Invoicing

An invoice will be sent to each buyer’s registered email by noon the morning after the auction end date.  Invoices will also be available through the auction software in the buyer’s auction profile.

 

Bidder’s Payment

After each auction ends, the credit card on file will be charged automatically and a PAID IN FULL invoice will be issued via email. Accepted forms of payment include Visa, MasterCard, Discover, or American Express. Bidders must have available funds on their credit card and must have a valid card on file to continue bidding. If a credit card is declined, the bidder will be given the opportunity to provide another credit card or payment via other electronic means.  Bidders who accumulate unpaid invoices risk losing their items and/or bidding privileges.  

 

Buyer’s Premium

A 15% buyer’s premium and a $1 fee per item will be added to all invoices. In addition, bidder’s will be charged applicable sales tax (for Flemington, NJ) unless an Exemption is on file with THE BLOCK prior to bidding.

 

Item Pick-Up Time

All items must be picked up within one week from the first auction pickup date.  This means that if you purchase items on a Friday and the first pick up date is Saturday, the final pickup date will be one week later on the following Saturday.  You can pick it up at any time on or after the first pick up date until the final pickup date. Your invoice will indicate the first pick up date and the final pickup date.  If for some reason you are not able to pick up by the final pickup date, you may email support@theblockoa.com and request additional time.  You must email support@theblockoa.com prior to the close of business on the final pickup date.

 

Additional time is intended to occasionally assist a buyer. However, the buyer should plan to bid on and purchase items only when they are available to pick up items within the one-week period.

 

If items are not picked up by the final pickup date and the buyer has not requested additional time, items will be considered abandoned and THE BLOCK may relist the items on a subsequent auction, dispose of, or donate the items. There are no exceptions.

We are located in Building D, Units 401-402.  Please enter through the garage door and check-in at the front desk.

 

Item Pickup

When you arrive to pick up your items, you will be required to present a copy of your invoice (either on your smartphone or on paper). If it is the first time you are picking up, we will also ask for your photo ID.  If someone other than the identified account holder will be picking up for you, you must email support@theblockoa.com and provide the person’s name.  The pickup person must present a valid ID.

 

Return Policy

PLEASE NOTE: While we accept returns for New or Like New items that were misdescribed, any returns must be brought back within 30 days of auction ending.  We cannot issue refunds 30 days past auction end date for any items.

 

Return Process: You must email support@theblockoa.com with a description of the issue and a photo, if applicable, before you bring back the item.  We will respond with a proposed course of action. This permits us to have a record of the return so that it can be more easily processed and so that our staff is not overwhelmed with return issues on pick up days.

 

Loss of Bidding Privileges

THE BLOCK, at its sole discretion, may block a bidder from further bidding because of non-payment or declined credit cards. If the buyer’s credit card is declined, issues persist, or the account is in violation of these Terms & Conditions, access to bidding may be blocked. In addition, THE BLOCK reserves the right to turn off bidding privileges. Privileges may be restored at the discretion of THE BLOCK.

 

Shipping

At this time, we do not offer shipping.

 

Tax Exemption

If a bidder is eligible for tax exemption, please email your tax exemption or reseller’s form to Support@TheBlockOA.com. We will apply tax exemption to any purchases made after submission of official documentation.  If you fail to provide documentation, you will need to apply to the state for a refund.

 

Scheduling of Auctions

We may delay, end, or extend the length of an auction. We may remove items from an auction listing at our discretion.  We may refuse the sale any time prior to payment or if we find that an item is missing or improperly described.

 

Auction Services

We are not licensed as an auctioneer or auction firm. We do not provide any type of auction services or auctioneering.

 

Auction Software

THE BLOCK utilizes software provided by Maxanet.  THE BLOCK will not be liable for any software or software malfunctions or deficiencies.

 

Consumer Privacy Statement

We use MaxanetPay as a service for processing credit cards.  MaxanetPay adheres to strict industry standards for payment processing, including 128-bit Secure Sockets Layer (SSL) technology for secure Internet Protocol (IP) transactions, industry leading encryption hardware and software methods, and security protocols to protect customer information.  MaxanetPay complies with the Payment Card Industry Data Security Standard (PCI DSS). THE BLOCK is not otherwise affiliated with MaxanetPay.

 

SUMMARY of Important Points:

  • ALL SALES ARE FINAL and no refunds will be made.
  • Allinvoices will be charged a 15% buyer’s premium plus a fee of $1.00 per item.
  • Items mustbe picked up within one week of the first pickup day.  This means that if you purchase items on a Friday, and the first pickup day is Saturday, you can pick up your items up to and including the following Saturday.
  • Items not picked up by the final pickup day are forfeited without refund and The Block may either donate, resell, or dispose of the items.

We will specify your final pick up date on your invoice.

  • If you are unable to pick up your items by the one week deadline, you must contact support@theblockoa.com prior to close of business on the final pickup day to ask that your items be held another day.
